1. Definitions
In these directions, a word or expression bears the meaning assigned to it in the Immigration Act, 2002 and regulations published on 18 March 2020 by the Minister of Cooperative Governments and Traditional Affairs in terms section 27(2) of the Disaster Management Act, 2002 (Disaster Management Regulations, 2020), unless the context otherwise indicates—2. Purpose
The purpose of these directions is to—(a)prescribe temporary measures or steps currently necessary to manage COVID-19 in order to reduce its impact in the Republic, by preventing the importation of, and minimising the local transmission of, the virus; and(b)provide directions to officials of the Department of Home Affairs and other organs of State, responsible for the implementation of the Immigration Act, 2002, and to the extent possible, disseminate information to all affected persons, on applicable measures as set out in the directions.3. Authority
4. Application
These directions apply to citizens, permanent residents and other foreign nationals to whom the Immigration Act, 2002 applies during the national state of disaster, except that during the National Lockdown paragraph 17 will apply.5. ***

17A. Entry into or exit from Republic for emergency medical attention for life-threatening condition
17A.1 A person who wishes to enter into, or exit from, the Republic for emergency medical attention for a life-threatening condition as contemplated in regulation 4(8) of the Regulations, must apply to an immigration officer at a port of entry, which immigration officer must inform the Minister of Home Affairs of the application and obtain approval for the intended travel.17A.2 When a person referred to in paragraph 17A.1 requires assistance with physical movement or care, the person providing assistance must be screened and, where applicable, be subjected to mandatory quarantine.17A.3 An application referred to in paragraph 17A.1 must be supported by—(a)documentary proof of the applicant’s life-threatening condition; and(b)a copy of the applicant’s valid passport.[paragraph 17 substituted with paragraphs 17A to 17D by section 2 of Government Notice R518 of 2020]17B. Entry by South African citizens or permament residents and exit by foreigners to be repatriated to countries of nationality or permanent residence
17B.1 A South African citizen or permanent resident, who wishes to enter into the Republic during the period of the national state of disaster must apply, 72 hours prior to the intended entry into the Republic, to the South African Mission in the country in which he or she is, or where there is no South African Mission, the Consular Services at the Department of International Relations and Cooperation, which Mission or the latter Department, must inform the Minister of Home Affairs of the application and obtain prior approval for the intended entry.17B.2 An application referred to in paragraph 17B.1 must be supported by—(a)a copy of the applicant’s passport or identity card or document;(b)a copy of the applicant’s permanent residence permit, if applicable; and(c)details regarding the applicant's travel itinerary in the last two months.17B.3 A South African citizen or permanent resident referred to in paragraph 17B.1 who is permitted to enter the Republic must, upon arrival at the port of entry, be referred for a mandatory quarantine.17B.4 A foreigner who is to be repatriated to his or her country of nationality or permanent residence during the period of the national state of disaster, must apply to the relevant diplomatic or consular mission in the Republic responsible for consular services pertaining to his or her country, 72 hours prior to the intended date of departure.17B.5 The diplomatic or consular mission referred to in paragraph 17B.4 must, through the diplomatic channel, and in accordance with guidelines issued by the Department of International Relations and Cooperation and the Department of Transport, notify the Minister of Home Affairs, or a person designated by him or her in writing, of the application and obtain prior approval for the intended exit.17B.6 An application referred to in paragraph 17B.4 must be supported by—(a)a copy of the applicant’s valid passport;(b)a copy of the applicant’s temporary residence visa or permanent residence permit; and(c)proof of the applicant’s means of travel.[paragraph 17 substituted with paragraphs 17A to 17D by section 2 of Government Notice R518 of 2020]17C. Officials of international organisations
17C.1 The application of parargraph 14 of the Directions is hereby extended to officials of international organisations accredited to the Republic and their families.17C.2 Subject to the applicable COVID-19 quarantine and isolation requirements determined by the Department of Health, the movement of resident diplomats, including movement for the purposes of providing consular support to foreign nationals and officials of international organisations accredited to the Republic, will be determined by the guidelines issued by the Department of International Relations and Cooperation through the diplomatic channel.[paragraph 17 substituted with paragraphs 17A to 17D by section 2 of Government Notice R518 of 2020]17D. Services to be rendered by Department of Home Affairs
The following services will be rendered by the Department of Home Affairs during Alert Level 4 of the period of the national state of disaster:(a)Re-issue of birth and death certificates;(b)issuance of temporary identity certificates;(c)registration of deaths;(d)registration of birth, excluding late registration of birth;(e)collection of identity cards or documents; and(f)application for, and collection of, passports for persons engaged in the delivery of essential goods across the borders of the Republic and those travelling outside of the Republic for receiving medical services.[paragraph 17 substituted with paragraphs 17A to 17D by section 2 of Government Notice R518 of 2020]17E. Services to be rendered by Department of Home Affairs under Alert Level 3
The following additional services will be rendered by the Department of Home Affairs during Alert Level 3 of the period of the national state of disaster, in addition to the services mentioned in paragraph 17D:(a)late registration of births;(b)solemnisation and registration of marriages; and(c)applications for identity cards or documents for learners.[paragraph 17E inserted by section 3 of Government Notice 664 of 2020 and substituted by section 2 of Government Notice 749 of 2020]17F. Services to be rendered by Department of Home Affairs under Alert Level 2
17F.1 The following additional services will be rendered by the Department of Home Affairs during Alert Level 2 of the period of the national state of disaster, in addition to the services mentioned in paragraphs 17D and 17E:(a)applications for first issue of Identity Card or Green Bar-coded Identity Document;(b)applications for Identity Cards or Green Bar-coded Identity Documents by persons who have been issued with a Temporary Identity Certificate during the national state of disaster, which certificates have expired;(c)applications for amendments of personal particulars;(d)applications for rectification of personal particulars; and(e)Back Officer records retrieval services.17F.2 All Temporary Identity Certificates issued during the period of the national state of disaster that have not yet expired on the date of commencement of this Directions are hereby extended up to 31 October 2020.[paragraph 17F inserted by section 2 of Government Notice 923 of 2020]17G. Services to be rendered by the Department of Home Affairs under Alert Level 1
17G.1. The following additional services will be rendered by the Department of Home Affairs during Alert Level 1 of the period of the national state of disaster with effect from 1 October 2020, in addition to the services mentioned in paragraphs 17D, 17E and 17F:(a)applications for identity cards or documents;(b)applications for all types of passports; and(c)visa services in terms of the Immigration Act, including submission of applications through VFS Global, in the following categories:(i)visitor’s visa, as contemplated in section 11(1)(a)(ii)visitor’s visa, as contemplated in section 11(1)(b);(iii)visitor’s visa, as contemplated in section 11(2);(iv)visitor’s visa, as contemplated in section 11(6);(v)study visa, as contemplated in section 13;(vi)treaty visa, as contemplated in section 14;(vii)business visa, as contemplated in section 15;(viii)crew visa, as contemplated in section 16;(ix)medical treatment visa, as contemplated in section 17;(x)relative’s visa, as contemplated in section 18;(xi)general work visa, as contemplated in section 19(2);(xii)critical skills work visa, as contemplated in section 19(4);(xiii)intra-company transfer work visa, as contemplated in section 19(5);(xiv)retired person visa, as contemplated in section 20;(xv)corporate visa, as contemplated in section 21;(xvi)exchange visa, as contemplated in section 22;(xvii)waiver of prescribed requirement, as contemplated in section 31(2)(c); and(xviii)appeal or review contemplated in section 8 against a decision on application for a temporary residence visa.17G.2 The services mentioned in paragraph 17G.1, including applications for a visitor’s visa, as contemplated in section 11(1)(a) of the Immigration Act, will also be rendered at the South African Missions abroad.17G.3 The application process for Lesotho Exemption Permits and Zimbabwean Exemptions Permits will open with effect from 1 October 2020.[paragraph 17G inserted by section 6 of Government Notice 1029 of 2020]17H.

19. Extension of validity period of asylum seeker permit and refugee status
An asylum seeker permit lawfully issued in terms of section 22 of the Refugees Act, 1998 (Act No. 130 of 1998) and a refugee status granted in terms of section 24 of the Refugees Act, 1998, which expired from 15 March 2020, or is to expire or which status was to be withdrawn during the period of the national state of disaster, is deemed to have been extended up to and including 31 January 2021.[paragraph 19 inserted by section 4 of Government Notice 664 of 2020 and amended by section 2.1 of Government Notice 843 of 2020 and by section 3.1 of Government Notice 1029 of 2020]['A holder of a visa or permit must adhere to the terms and conditions of his or her visa and any activity not endorsed onto such visa or permit is prohibited.' is noted in section 2.2 of Government Notice 843 of 2020 and in section 3.2 of Government Notice 1029 of 2020]20. Extension of validity period of Lesotho Special Permit
A Lesotho Special Permit lawfully issued in terms of section 31(2)(b) of the Immigration Act, 2002 (Act No. 13 of 2002) which has expired is deemed to have been extended up to and including 31 January 2021.[paragraph 20 inserted by section 4 of Government Notice 664 of 2020 and amended by section 2.1 Government Notice 843 of 2020 and by section 3.1 of Government Notice 1029 of 2020]['A holder of a visa or permit must adhere to the terms and conditions of his or her visa and any activity not endorsed onto such visa or permit is prohibited.' is noted in section 2.2 of Government Notice 843 of 2020 and in section 3.2 of Government Notice 1029 of 2020]21. 22. Visits to Lindela Holding Facilitly

23A.1 Any person, from a country listed as having a high COVID-19 infection and transmission rate, who wishes to, with effect from 1 October 2020, undertake a business travel into the Republic as contemplated in regulation 75(5) of the Regulations may, in writing, apply to the Minister of Home Affairs and demonstrate reasons for his or her request to enter the Republic for business purposes during the period of the national state of disaster.23A.2 An application referred to in paragraph 23A.1 must be made to email Covid19BusinessTravel@dha.gov.za and supported by—(a)a copy of passport and/or temporary residence visa;(b)proof of business activities to be undertaken in the Republic;(c)proof of travel itinerary; and(d)proof of address or accommodation in the Republic.23A.3 Any person who is allowed entry into the Republic will be subjected to the prescribed screening procedures and isolation or quarantine rules, as the case may be, which include—(a)provision of a valid certificate of a negative test obtained not more than 72 hours before the date of travel; and(b)in the event of failure to submit a certificate as proof of a negative test, such person will be required to quarantine at his or her own costs.23A.4 The list of such countries determined as having a high COVID-19 infection and transmission rate will be published, from time to time, on the website of the Department of Home Affairs.[paragraph 23A inserted by section 7 of Government Notice 1029 of 2020]- Entire Government Notice
